The act was passed by the house of assembly of Dominica on December 1, 2021. Cabinet has approved the commencement date according to Section 86 of the Act.

Roseau, Dominica: The Minister of Public Works and the Digital Economy Cassanni Laville has shared an update on the Public Procurement and Disposal of Public Property Act of 2021 and stated that it would come into effect on April 1, 2022. 

The act was passed by the house of assembly of Dominica on December 1, 2021. Cabinet has approved the commencement date according to Section 86 of the Act. 

Outlining the various aspects of the Act, Minister Laville noted,” Section 18 provides for the minister of finance to make regulations to give effect to the provisions of the act. Cabinet has further prooved the public procurement and disposal of the public property regulation 2022″. 

He further stated that the key objective of the act is to modernize public procurement in accordance with principles of good governance and to establish the tension required for the implementation of the new legislation. It is named the public procurement board and the procurement review council. 

“The act also aims to encourage the participation of suppliers, contractors and consultants in public procurement proceedings”, underscored the Minister of Public Works. 

He further highlighted various criteria and producers of the act while procuring the property: 

  • The regulations outlined procurement criteria, including the requirement to publish open, competitive procurement opportunities, content required to bidding documents, as well as the required bid security. 
  • It includes measures to promote domestic industries and social and economic development procurement by micro, small and medium-sized enterprises. Enterprise led by women, youth, the elderly and the person with a disability and other groups identified by the ministers
  • According to the regulations, bids will be examined by the evaluation committee to ensure that it meets the basic eligibility criteria prior to a more exhaustive evaluation. 
  • The regulations provide for two stages of bidding for an open competitive procurement process: the technical evaluation and the final bid continuing prices and other financial details. 
  • Procurement method, detail, the term of consultancy contracts and requires the selection process which is based on quality and cost method. 
  • The quality and cost method uses a competitive process among short-listed consultants, which considers both the technical quality of the proposals and the cost of this service. 
  • Regulation for the prospect of the property is also outlined as well as procedures for challenge and review. A request for review will be assigned to the review council after it is large to the secretariat.
